Welcome to COT Digest (“we”, “us”, “our”), a subscription-based newsletter and data platform that provides weekly insight into CFTC Commitments of Traders (COT) positioning across FX and commodity markets. These terms and conditions govern your use of the website and services at https://cotdigest.com (the “Service”). By subscribing, creating an account, or otherwise using the Service, you agree to these terms.

1. Description of the Service

COT Digest offers:

• Free tier: The Currency COT Digest, a weekly email newsletter covering speculative positioning in major FX futures.
• Paid tier: The Commodity COT Digest and related premium content, including weekly newsletters on energy, metals and agricultural markets, and access to raw and historical COT data where applicable.

Content is delivered by email and may be accessed via the website. We reserve the right to modify, suspend or discontinue any part of the Service with reasonable notice where practicable.

2. Not Financial or Trading Advice

All content provided by COT Digest is for informational and educational purposes only. It is not intended as, and must not be relied upon as, financial advice, investment advice, or trading advice. We do not make recommendations to buy, sell or hold any instrument. Positioning data reflects past reporting periods and provides context on sentiment and exposure; it is not a signal or guarantee of future price movement. You are solely responsible for your own trading and investment decisions.

3. Eligibility and Account

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. You may use the Service as an individual or on behalf of a business, provided you have authority to bind that business to these terms. You are responsible for keeping your account credentials secure and for all activity under your account.

4. Subscriptions and Billing

• Paid subscriptions are available on a monthly or yearly basis. Prices are displayed at the time of sign-up and may be in GBP or other currencies as shown.
• Payments are processed via Stripe. By subscribing, you agree to Stripe’s terms and to provide accurate, current payment information.
• Subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date. You may cancel at any time via your account or billing settings; access continues until the end of the current billing period.
• No refunds are offered for partial use of a billing period. All sales are final. We may make exceptions at our sole discretion where required by law.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these terms. You must not:

• Copy, resell, redistribute or commercially exploit our newsletters, data or content (including by sharing login details for the purpose of circumventing a paid subscription).
• Use the Service in any way that could damage, disable or impair the Service or interfere with others’ use.
• Attempt to gain unauthorised access to our systems, other accounts or any third-party data.
• Use the Service for any fraudulent or illegal purpose or in violation of applicable laws.

We may suspend or terminate your access if we reasonably believe you have breached these terms.

6. Intellectual Property and Copyright

All content, data, design and materials on the Service are owned by us or our licensors and are protected by copyright and other intellectual property laws. You may not reproduce, distribute or create derivative works from our content except for your own personal, non-commercial use in connection with your subscription.

• Your full contact details
• A description of the work you claim has been infringed
• The location (e.g. URL or description) of the allegedly infringing material
• A statement that the information is accurate and that you are the rights holder or authorised to act on their behalf

7. Limitation of Liability

To the fullest extent permitted by law:

• The Service is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, error-free or free of harmful components.
• We are not liable for any indirect, incidental, special or consequential loss or damage (including loss of revenue, profits, data or business opportunity) arising from your use of or inability to use the Service or reliance on any content.
• Our total liability to you for any claims arising out of or in connection with these terms or the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use and protect your personal data.

9. Changes to These Terms

We may update these terms from time to time. We will post the revised terms on this page and update the effective date. Material changes may also be communicated by email or a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated terms. If you do not agree, you must stop using the Service and may cancel your subscription.

10. General

These terms constitute the entire agreement between you and COT Digest regarding the Service. If any part of these terms is held to be invalid or unenforceable, the remaining parts will remain in effect. Our failure to enforce any right or provision does not waive that right or provision.

11. Governing Law and Jurisdiction

These terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
